1. About us
These terms apply to the services provided by Aarsal Properties Ltd. Aarsal Properties Ltd. is part of Aarsal Holdings Ltd. and owned by Aarsal Holdings Ltd. We are registered in England and Wales with our registered office at 1st Floor, Interchange House, 81-85 Station Road, Croydon, CR0 2RD. References to “we”, “us” and “our” mean Aarsal Properties Ltd.
2. Our agreement with you
A contract is formed when you accept a quotation or instruct us to market your property, whichever happens first. These terms, together with your instruction confirmation and the package details on our fees page, form the whole agreement between us.
3. Our services
- Valuation and marketing advice for the sale or letting of your property.
- Preparation of marketing materials including photography, floorplans and descriptions.
- Advertising your property on our website and third-party property portals.
- Handling enquiries, arranging viewings and communicating offers.
- Progression support through to exchange, completion or the start of a tenancy.
We act as your agent. We do not provide legal, tax, financial or structural advice and you should take independent professional advice where appropriate.
4. Your obligations
- Provide accurate, complete information about the property and your ownership of it.
- Disclose any matter that could affect a buyer's or tenant's decision.
- Provide identification and documents we need for legal compliance checks.
- Give us reasonable access for photography, viewings and inspections.
- Tell us promptly if you receive an offer or approach directly.
5. Fees and payment
Our fees are those set out on our fees page or in your written quotation, and include VAT unless stated otherwise. Selling fees are payable on legal completion or ten months after instruction, whichever occurs first, unless your quotation states otherwise. Letting and management fees are payable as set out in your landlord agreement.
Where an invoice is not paid by its due date we may charge interest at 4% above the Bank of England base rate. Additional services requested by you, such as extra photography or brochures, are chargeable at the rates quoted at the time.
6. Cancellation rights
If you are a consumer you have the right to cancel within 14 days of instructing us, without giving a reason. If you ask us to begin providing services during that period and then cancel, you must pay for the services already supplied. To cancel, contact us in writing at hello@aarsalproperties.co.uk.
7. Term and termination
Either party may end the agreement by giving 14 days' written notice, subject to any minimum term stated in your quotation. Fees already incurred, and any fee that becomes payable because a buyer or tenant we introduced later completes, remain due.
8. Referrals
We may refer you to mortgage advisers, conveyancers, surveyors and other providers. You are never obliged to use them. Where we receive a referral fee we will disclose it to you before you proceed.
9. Liability
We provide our services with reasonable care and skill. We are not liable for losses that are not foreseeable, for loss of profit or opportunity, or for delays caused by third parties such as solicitors, lenders or other parties in a chain. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.
10. Website use and intellectual property
Property listings, photographs and other content on this website are provided for general information and may change. All content, trade marks and branding are owned by Aarsal Properties Ltd. or Aarsal Holdings Ltd. and may not be reproduced without permission. You must not misuse the website, attempt to gain unauthorised access, or scrape our listings.
11. Complaints
If something goes wrong, please follow our complaints procedure. We are committed to resolving complaints fairly and promptly.
12. Governing law
These terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction, save that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
